Affiliate program terms.

Thank you for your interest in the MuteDeck Affiliate Program. By participating in our program, you agree to the following terms and conditions.

1.Approval or Rejection of the Application

We reserve the right to approve or reject any Affiliate Program Application at our discretion. If your application is rejected, please note that there will be no legal recourse against us.

2. Commissions

Commissions will be paid on a monthly basis. To be eligible for payout, a commission must first be confirmed. Commissions are confirmed 14 days after the referred purchase, once the refund window has passed.

Commissions require a minimum confirmed balance of €25 to be eligible for payout. Payouts are made in euros via PayPal.

You are not allowed to refer yourself, and commissions will not be earned on your own accounts. Only one commission will be paid per referral. If a user clicks the link on your site and places multiple orders, you will only receive a commission on the first order.

Payments will only be issued for successfully completed transactions. Any transactions resulting in chargebacks or refunds will not be eligible for commission payout.

3. Termination

Your affiliate application and status may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (false claims, misleading information, etc.).
• Spamming (mass emails, mass postings, etc.).
• Advertising on sites promoting illegal activities.
• Failure to disclose the affiliate relationship for any endorsement under existing Federal Trade Commission guidelines, relevant state laws, or regulations.
• Violation of intellectual property rights. MuteDeck reserves the right to require license agreements to protect our intellectual property rights.
• Offering rebates, coupons, or kickbacks from your affiliate commission as an incentive. However, adding bonuses or bundling other products with MuteDeck is acceptable.
• Self-referrals, fraudulent transactions, or suspected affiliate fraud.
• Any violations of this agreement or for reasons determined by MuteDeck at its discretion.

4. Affiliate Links

You may use graphic and text links on your website and within your email messages to advertise MuteDeck. Additionally, you are permitted to promote MuteDeck through online and offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us, or you may create your own as long as they comply with the conditions outlined in Section 3.

5. Coupon and Deal Sites

MuteDeck occasionally offers coupons to specific affiliates and newsletter subscribers. If you have not been pre-approved or assigned a branded coupon, you are not allowed to promote the coupon. Please adhere to the following terms when promoting our products in relation to a deal or coupon:

• Do not use misleading text on affiliate links, buttons, or images that imply unauthorized deals.
• Do not bid on MuteDeck coupon-related keywords or phrases.
• Do not generate pop-ups, pop-unders, iframes, frames, or any other actions that set affiliate cookies without the user expressing explicit interest in activating a specific savings.
• Coupon/deal/savings information must be visible to the user before an affiliate cookie is set.
• Do not use phrases like "Click for Deal/Coupon" when no coupons or deals are available.

6. Liability

MuteDeck will not be liable for any indirect or accidental damages (e.g., loss of revenue, commissions) resulting from affiliate tracking failures, database file loss, or any harmful intents towards our program or website(s).

We do not make any expressed or implied warranties regarding the Program and/or the products sold by MuteDeck. We cannot guarantee error-free operation of the Program or our website(s), and we will not be liable for any interruptions or errors.

7. Term of the Agreement

This Agreement begins upon your acceptance into the Program and ends when your Affiliate account is terminated.

We reserve the right to modify the terms and conditions at any time. If you find any modifications unacceptable, your only option is to terminate your Affiliate account. Your continued participation in the Program constitutes acceptance of any changes.

8. Indemnification

As an Affiliate, you shall indemnify and hold harmless MuteDeck, its affiliates, officers, directors, employees, licensees, successors, and assigns from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses arising from your negligence, misrepresentation, failure to disclose, or intentional misconduct.

9. Governing Law, Jurisdiction, and Attorney Fees

This Agreement is governed by the laws of the Netherlands. Any disputes arising under or related to this Agreement shall be adjudicated exclusively in the state courts located in the Netherlands.

In the event of litigation to enforce any provision of this Agreement, the prevailing party will be entitled to recover its costs and fees, including reasonable legal fees, from the other party.

10. Electronic Signatures Effective

By completing the MuteDeck affiliate application process, you indicate your acceptance of this Agreement and all its terms and conditions. This electronic signature holds the same legal force and effect as a handwritten signature.
